Wells v. State

Facts:

Defendant was charged with assault with intent to rape and murder in the first degree. The trial court convicted defendant of the charges. On appeal, defendant contended that to sustain his conviction under the felony-murder doctrine utilized by the trial court, the evidence had to be legally sufficient to support the underlying conviction of assault with intent to rape and that there had to be corroboration of the testimony of an accomplice witness sufficient to independently establish the corpus delecti of the assault with intent to rape the victim. The court affirmed the judgment of the trial court. The court held that: (1) the accomplice witness’s testimony clearly established that defendant assaulted the victim with the intent to rape her and that the circumstances were such that the assault amounted to an “attempt” to perpetrate a rape within the ambit of Md. Ann. Code art. 27, § 410; and (2) assuming the law of Maryland to be that an accomplice’s testimony that a crime was committed had to be corroborated by some independent evidence of the corpus delecti, it was clear that there was such corroboration in the case, including an autopsy report and defendant’s testimony.

  • By Md. Ann. Code art. 27, § 410, All murder that is committed in the perpetration of, or attempt to perpetrate any rape is murder in the first degree. The essential ingredients of the crime of assault with intent to rape are (a) an assault, (b) an intention to have carnal knowledge of a female, and (c) a purpose to carry into effect this intention with force and against the consent of the female. Whatever differences may exist between an attempt to commit a rape and an assault with intent to commit that crime, an aggravated assault with the intention of committing rape may also constitute an attempt to commit that crime within the purview of Md. Code Ann. art. 27, § 410. To constitute the crime of assault with intent to rape, the proof must establish, beyond a reasonable doubt, that the attempt is committed with force. Evidence corroborating the testimony of an accomplice is not sufficient if it merely shows the commission of the offense or the circumstances thereof; it must support some of the material facts that tend to show that the accused is either identified with the perpetrators of the crime or has participated in the commission of the crime itself.
